How Your Personal Information Is Collected and Used
Introduction PotSaver collects information in different ways from its Visitors and Patients who access the various parts of our Website. We use this information primarily to provide a customized experience as you use our Website, and also to collect, transfer, manipulate, store, and disclose for purposes of measuring and improving our Website and to send you information about our Website or to advertise additional services to you. From time to time, PotSaver may notify Patients of new products, announcements, upgrades and updates. Patients may opt-out of these promotional mailings by sending an email with their name to: firstname.lastname@example.org.
Registration Subject to our compliance with HIPAA, all Patients may be asked to provide certain personal information when they sign up for our Services such as name, address, telephone number, billing information (such as a credit card number), birth date, and the type of personal computer being used to access the Site. The personal information collected from Patients during the registration process is used to manage each Patientâ€™s PotSaver account. This information is not shared with third parties, unless specifically stated otherwise or in special circumstances.
Personal information may be collected by PotSaver when you use our Site. Such personal information may include: name, address, email address, date of birth, social security number, telephone & fax numbers, payment information and other personal information that you upload or enter into the Site and/or the App. PotSaver may also hold other details from your social networking user profiles (e.g., Facebook), if you have provided those user identities to PotSaver, including, without limitation, your usernames, passwords, birth date, friends, personal interests, gender, education and occupation. Information, which you add to your online public identities, is accessible on the World Wide Web, which is a public domain. You use the Site and/or app and post content at your own risk. Other people may view your online public identity and use it (for example, by tagging you, adding you, or including you in a group). You should be aware that if you delete the Site and/or app from, for example, your Facebook Apps, or you cancel your registration with PotSaver or make private information, which you have previously made public on any social networking system, some information may remain on public cache databases, including PotSaverâ€™s. If you become aware of any information, which you wish to remove, please notify PotSaver at email@example.com and we will take all reasonable steps to remove it. We may be obligated to disclose your personal information in very special circumstances such as when we are required to do so by law or in other special cases, as described below.
When you visit our website we may also collect “click stream data” (server address, domain name). This information can be combined with information you have provided to us by registering, for example, which will enable us to analyze and better customize your visits. We may use click stream data for traffic analysis or e-commerce analysis of our website, to determine which features of our site are most or least effective or useful to you.
We may provide your personal information and the data generated by cookies and the aggregate information to the vendors and service agencies that we may engage to assist us in providing our Site and/or App to you. For example, we may provide your personal information to a credit card processing company like PayPal to process your payment if using or participating in as a Patient on the Site and/or App.
In instances where PotSaver and a partner jointly promote the Site and/or App, we may provide the partner certain personal information, such as the name, e-mail address, age, and username of persons who subscribed to the Site and/or App as a result of the joint promotion for the sole purpose of allowing us and the partner to assess the results of the promotion. However, in this instance, personal information may not be used by the partner for any other purpose. We may also generate non-identifying and aggregate profiles from personal information Patients provided during registration (such as the total number, but not the names, of Patients). As explained in more detail below, we may use this aggregated and non-identifying information to sell advertisements that appear on the Site and/or App.
Use of General Information
We will primarily use the personal information you provide and any general information we receive from you to provide products and services to you, including, but not limited to, the following:
- To administer a content promotion survey or other site and to provide you with the relevant products or services (for example, to deliver a prize you may have won in a contest).
- To send you information or materials via e-mail about products, offers, and news we think might interest you. This information may relate to products, offers, and news of the PotSaver or its licensees or selected commercial partners. We send you this only if you have double-opted-in to receive e-mails from PotSaver. If you no longer wish to receive any e-mails from us, or if you want to modify your personal data or want your personal data to be deleted from our database, see Section 12.
- To analyze visits to the website and learn about the interests of our visitors in aggregate and also on a personal level to better understand your interests and needs, so we can improve our products and services and deliver to you the type of content, features and promotions that you are most interested in.
Our Company Partners and Sponsors Some products and services may be offered to Patients in conjunction with an affiliate, independent contractor seller or non-affiliated partner using publicly available information. In some instances, to provide Patients some of these products and services, the partner may need to collect and maintain personal information. In these instances, subject to our compliance with HIPAA, you will be notified before any such data is collected or transferred and may decide not to use that particular service or feature.
Additionally, our partners may have advertisements or co-branded Web Pages that are cosponsored by an affiliate, independent contractor seller, or non-affiliated partner. PotSaver may share non-identifying and aggregate information (except as described above), but not personal information, with such partners in order to administer the co-branded products or services offered.
Online Advertisements PotSaver may display our online advertisements. In those cases we share aggregated and non-identifying information about Patients collected through the registration process as well as through online surveys and promotions with these advertisers.
Additionally, in some instances, we use this aggregated and non-identifying information to deliver tailored advertisements or joint ventures. For instance, an advertiser or joint venture company tells us the audience they want to reach and provides us an advertisement tailored to the audience. Based upon the aggregated and non-identifying information we have collected, we may then display or send the advertisement to the intended audience. PotSaver does not share personal information about any of its Patients with these advertisers or joint venture companies.
Voluntary Customer Surveys We may periodically conduct both business and individual customer surveys. We encourage all Patients to participate in these surveys because they provide us with important information that helps us to improve the types of products and services we offer and how we provide them to you. Your personal information and responses will remain strictly confidential, even if the survey is conducted by a third party. Participation in our customer surveys is voluntary.
We may take the information we receive from individuals responding to our Customer Surveys and combine (or aggregate) it with the responses of other Patients we may have, to create broader, generic responses to the survey questions (such as gender, age, residence, hobbies, education, employment, industry sector, or other demographic information). We then use the aggregated information to improve the quality of our services to you, and to develop new services and products. This aggregated, non-personally identifying information may be shared with third parties.
Special Cases In accordance with HIPAA, it is PotSaver â€˜s policy not to use or share the personal information about Patient in ways unrelated to the ones described above without also providing you an opportunity to opt out or otherwise prohibit such unrelated uses.
Other than to the companies belonging to PotSaver for the purposes set out herein, and except as described in this policy, we do not sell, trade, or otherwise transfer your personal information or general information to third parties without informing you in advance. We provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties (collectively, “service partners”). Our service partners may use your personal information to operate our sites and to deliver their services. For example, your data may be transferred to website hosting partners and other parties who assist us in designing and operating the website, executing services (such as for prize fulfillment), or helping us analyze collected data. These parties will only use your data for the purpose of carrying out the work as agreed with us and will be required to keep the information confidential. We will encourage our service partners to adopt and post privacy policies. However, the use of your personal information by our service partners is governed by the privacy policies of those service partners and is not subject to our control. Please also see below on how we will respond to “do not track” signals.
PotSaver will only release personal or general information without your consent for security purposes, when required by law, or to prevent imminent harm to any person or entity. We will disclose personal or general information upon receipt of a court order or subpoena, or to cooperate with a law enforcement investigation, which may include responding to requests and court orders from jurisdictions outside the United States. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful, as determined in our sole discretion. Release of your personal data for security purposes, as described in this agreement to any person or entity under any circumstances shall be based on a determination made solely by us, exercising our own discretion, permission for which is expressly granted by you to us in accordance with this policy.
How you can access and correct your personal information or remove material you no longer wish to be accessible via the Site
If you wish to access and correct any personal information that we hold about you, or remove any material you have placed on the Site and/or the App or which is accessible on the Site via any other of your online identities, please contact us at firstname.lastname@example.org and we will respond to your request as soon as possible, generally within 24 hours. Be aware, however, that in the event you modify your personal information that we hold about you, we may need to run another pre-verification check on you. You can also access and correct some of the information we hold about you directly on the Site and/or the App (for example, your profiles and identities information) by logging into your account on PotSaver.
What Security Measures We Use Some of your user information and data you upload to the Site and/or App, such as Social Media Analytics Platforms are password-protected for your privacy and security. We take other reasonable steps to secure your personal information, and to protect it from misuse, loss, unauthorized access or modification. Although PotSaver uses commercially reasonable safeguards to protect your personal information, the Internet is inherently insecure and we cannot guarantee that the Site and/or the App or your information is secure (â€œhacker-proofâ€). When your personal information is no longer required by PotSaver, we destroy or permanently de-identify the information within one (1) year of the date that you terminate your account on PotSaver or there is no activity on your account.
Please keep in mind that whenever you give out personal information online there is a risk that third parties may intercept and use that information. While PotSaver strives to protect your personal information and privacy, we cannot guarantee the security of any information you disclose online. By using this site, you expressly acknowledge and agree that we do not guarantee the security of any data provided to or received by us through this site and that any personal information, general information, or other data or information received from you through the site is provided to us at your own risk, which you expressly assume.
If you are a Visitor or Patient, we may use a cookie to save your settings and to provide customizable and personalized services such as to identify your location and to deliver relevant content. These cookies do not enable third parties to access any of your customer information.
Facebook and PotSaverâ€™s partners may also use their own cookies. We do not control use of these cookies and expressly disclaim responsibility for information collected through them.
PotSaverâ€™s California Do Not Track Policy We do not track our Visitors or Patients over time and/or across third party websites to provide targeted advertising and therefore do not respond to Do Not Track (DNT) signals. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, you can modify the preferences on your browser to set the DNT signal so that third parties (particularly advertisers) know you do not want to be tracked. Please consult your browser for instructions on how to change the preferences to â€œDo Not Track.â€
PotSaver â€˜s Commitment to Childrenâ€™s Privacy Protecting childrenâ€™s privacy is especially important to us. It is our policy to comply with the Childrenâ€™s Online Privacy Protection Act of 1998 and all other applicable laws. Therefore we restrict the Site and the App to persons twenty-one (21) years or older.
YOU MUST BE TWENTY-ONE (21) YEARS OR OLDER TO ACCESS THE SITE AND THE APP. IF YOU ARE UNDER TWENTY-ONE (21) YEARS OF AGE, THEN YOU ARE NOT PERMITTED TO ACCESS THE SITE, THE APP, OR ANY FEATURE OR OTHER PART OF OUR SERVICES. NOTWITHSTANDING THE FOREGOING, DUE TO THE AGE RESTRICTIONS FOR USE OF THIS WEBSITE, NO INFORMATION OBTAINED BY THE SITE AND/OR APP, FALLS WITHIN THE CHILD ONLINE PRIVACY ACT (COPA) AND IS NOT MONITORED AS DOING SO.
The Site is not aimed at children under 13 years old and we will not collect, use, provide or process in any other form any personal information of children under the age of 13 deliberately. We therefore also ask you, if you are under 13 years old, please do not send us your personal information (for example, your name, address and email address).
YOUR CALIFORNIA PRIVACY RIGHTS Under California Civil Code sections 1798.83-1798.84, California residents are entitled to ask us for a notice describing what categories of personal information we share with third parties or affiliates for those third parties or affiliatesâ€™ direct marketing purposes. That notice will identify the categories of information shared and will include a list of the third parties and affiliates with which it was shared, along with their names and addresses.
